By accessing or using Usebot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Usebot provides a chatbot platform that enables you to create, deploy, and manage AI-powered chatbots for your website. The Service includes:

  • Bot creation and configuration tools
  • Embeddable chat widgets
  • Lead capture and conversation management
  • Integration with third-party services (Stripe, OpenAI)
  • Analytics and reporting features

3. Account Registration

3.1 Account Creation

You must create an account to use the Service. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Be responsible for all activity under your account
  • Notify us immediately of any unauthorized use

3.2 Age Requirement

You must be at least 18 years old to use the Service.

4. Subscription Plans and Billing

4.1 Pricing Tiers

We offer multiple subscription tiers (Free, Starter, Pro, Growth) with different features and limits. Current pricing is available on our website.

4.2 Billing

  • Paid subscriptions are billed monthly in advance
  • All fees are in British Pounds (£) unless otherwise stated
  • Payments are processed securely through Stripe
  • You authorize us to charge your payment method for all fees
  • Failed payments may result in service suspension

4.3 Cancellation and Refunds

  • You may cancel your subscription at any time through the Customer Portal
  • Cancellations take effect at the end of the current billing period
  • No refunds for partial months or unused features
  • Free tier accounts may be deleted after prolonged inactivity

4.4 Price Changes

We may change our pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Engage in spam, phishing, or fraudulent activity
  • Harass, abuse, or harm others
  • Attempt to breach or test security systems
  • Use the Service to compete with us
  • Scrape, crawl, or reverse engineer the Service
  • Exceed rate limits or abuse API access
  • Share account credentials with unauthorized users

6. Usage Limits

Each subscription tier has specific limits on sessions, bots, and features. Exceeding your tier's limits may result in:

  • Temporary service suspension
  • Request for upgrade to a higher tier
  • Additional charges for overage (if applicable)

7. Intellectual Property

7.1 Our IP

The Service, including all software, designs, text, graphics, and trademarks, is owned by Custom Growth Solutions Ltd (trading as UseBot) and protected by intellectual property laws. You may not copy, modify, or create derivative works without our permission.

7.2 Your Content

You retain ownership of the content you create using the Service (bot configurations, conversations, etc.). You grant us a license to use, store, and display your content solely to provide the Service.

8. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Third-Party Services

The Service integrates with third-party providers (Stripe, OpenAI, etc.). Your use of these integrations is subject to their respective terms of service. We are not responsible for third-party services.

10. Warranties and Disclaimers

The service is provided "as is" without warranties of any kind, express or implied. We do not guarantee:

  • Uninterrupted or error-free operation
  • Accuracy or reliability of AI-generated responses
  • Compatibility with all browsers or devices
  • Security against all threats
  • Specific business results or outcomes

11. Limitation of Liability

To the maximum extent permitted by law, Usebot shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or data loss
  • Third-party actions or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Usebot from claims, damages, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of others
  • Content you submit or chatbots you create

13. Termination

13.1 By You

You may terminate your account at any time through your dashboard settings.

13.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Fail to pay fees when due
  • Engage in fraudulent or illegal activity
  • Pose a security or legal risk

13.3 Effect of Termination

Upon termination, your access to the Service will cease, and your data will be deleted in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be resolved in the courts of England and Wales.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Usebot
  • Severability: If any provision is invalid, the remaining provisions remain in effect
  • Waiver: Failure to enforce any right does not constitute a waiver
  • Assignment: You may not assign these Terms; we may assign to affiliates or successors
  • Force Majeure: We are not liable for delays due to events beyond our control
